Yes. The flat rake is much worse than the 10% capped at $4 that
I've seen in Nevada. It is particularly bad if you have a tight
aggressive image and thus are more likely to take down small pots
early (for example, if the flop misses everyone and you bet).
And, also, don't the Bay101 and Garden City $2-$4 games also
take that same $4? I wonder what happens if the little blind
calls and the hand is checked down to the end. Does the house
get the whole pot?
I'm not sure. Technically, there would be no pot on the flop,
since
the blinds would be dropped at that point. I think in practice
the players are not stupid enough to do that... the small blind
would
typically fold. Even if the small blind raised and the big blind
folded, the house would still drop $1, so you'd be betting $3 to
win $2.
Despite all this, Bay101 seems as busy as ever...
