I have not heard anything as to "why"...
With the combination of $4 drop per hand and the
use of ShuffleMasters, I would estimate that they have
nearly doubled the income per table, at least at $3/6
and similar low limits.
As for "how they get away with it", I blame the
popularity of poker--the market will bear the
higher price.
Having said that, I've now put in a few hours at
3/6 under the new structure, and have tentatively
concluded that the extra drop doesn't hurt a solid
Specifically, if you're playing tight and only taking
down a few big pots during a session, it is better to
be charged $4/pot rather than $3/orbit. To look at
it another way, it costs $4/orbit to fold, rather than
$7/orbit, which is a significant break for the tight
player.
On the other hand, I think the new structure is detrimental
for the loose gamb00lers who tend to be in lots of pots, but
I think that the cost is sufficiently "hidden" from them.
For the most part, the games seem to be staying loose
and juicy, so I think $3/6 is probably somewhat more
beatable with the $4 flat rake than it was with the $3 live
button charge--just as long as the fishies don't get taxed
to the point that they swim away...

When Foxwoods converted a bunch of limits from time to a
rake, they said it was "by popular demand". Since it
raised their collection significantly, either the players
were idiots or the management was using player demand
as a cover.
Did Bay 101 offer a cover story for this one? They
didn't say anything in March for the $1 extra per pot
from $2-$4 HE and from Omaha.
