It's no more or less eligible than the money that is raked where there is a percentage rake. Another way of looking at a game with a button charge is "3 blinds - $1 small, $3 big, $3 dealer with a 100% rake to $3." That the house calls it a time charge doesn't change its actual effect.
It being live doesn't change that. It just changes your strategy.
Those statements are mutually exclusive. With a live button, that it was my chips that were dropped doesn't change that I have a bet in. With a dead button, I don't have a bet in.
With a live button, the winner of the pot receives $3 less than he would have in a uncharged game of the same conditions (including a $3 dealer blind) - in other words, a game where the winner of the pot pays the time.
